Georgia Traffic Warrants

When faced with a traffic violation in the state of Georgia, the best thing to do is try and resolve your issue as soon as possible to avoid further fines and possible time in prison.
All Georgia traffic citations will have a date printed clearly on the citation by which you must respond. You can respond either by paying the fine or contesting the ticket. Factors that determine this are the nature of the violation and any previous traffic offenses you may have.


Contest The Ticket (Plead Not Guilty)
If you fight the ticket, that means you must appear in front of a judge during a hearing to decide your guilt or innocence. You can hire a traffic ticket lawyer to represent you in court or you can represent yourself if you feel the offense is a simple violation. If you're found not guilty, the violation is erased and you aren't required to paid the fines. If you're found guilty, you are responsible for all fines, insurance penalties, jail sentence, probation, or driver safety courses issued by the judge. Whatever warrant you are charged with goes on your record. After a guilty decision is reached, you always have the right to appeal the verdict if you feel you're innocent of the charges.
Failure to Appear (FTA) Status and Penalties in the State of Georgia

Georgia enforces a failure to appear status for any citizen (in state or our of state)  who misses a court date for criminal or traffic violations. Any time you fail to appear in court, you can be charged with a Failure to Appear (FTA) or what's known as bail jumping. Bail jumping is taken seriously by the state of Georgia and could result in additional fines since the bail that was set at your original arraignment was seen as a guarantee that you would resolve your violation with the state through the court system. The potential consequences are dependent on the original charge. In any case you will be in jeopardy of license suspension and a warrant may be issued for your arrest. If you find yourself in this situation, it's advised to seek legal counsel and schedule a court date at a Failure to Appear (FTA) hearing to avoid further penalties. At that time, your drivers license may be reinstated if certain requirements are met.

Felony Bail Jumping
You can be charged with felony bail jumping if you were charged with a traffic violation classified as a felony and failed to appear in court for your court date. A traffic or vehicular felony is a serious offense which usually results in bodily harm or death to an individual.

Misdemeanor Bail Jumping
If your traffic violation falls under a misdemeanor and you failed to appear in court for your court date, you can be charged with misdemeanor bail jumping. These types of charges are less serious is nature and generally don't involve physical harm to others.

How to Fight a Traffic ticket in Georgia

The Department of Driver Services is required to suspend your Georgia drivers license for the following offenses:

Any Major Driving Violation Including:

     Vehicular Homicide
     Any Felony Committed Using a Vehicle
     Fleeing a Police Officer for Any Reason
